Dilapidations Assessments
ARC takes a very pragmatic, commercial approach to dilapidations, whether in the preparation of dilapidation assessments for a tenant during the term of a lease, the preparation of a schedule of dilapidations for a landlord at or near expiry of a lease, or the subsequent negotiations of a settlement, and project management of the compliance works. We have saved tenant clients significant amounts by negotiating lower settlements when they have been served with a schedule by the landlord. We have also achieved very good results for landlords enabling their property to be returned in a condition ready for new tenants, thereby limiting void periods.

Building Condition Surveys and Defects Investigations and Analysis
Elements of buildings have, and always will deteriorate through time. The rate of that deterioration will be dependent on a number of factors including the quality of the original design, materials and workmanship, the level of ongoing maintenance, and a number of external factors such as location, orientation, thermal movement, etc.

Many building owners are not fully aware of the condition of their properties and until failure of an element occurs, no maintenance/inspection has usually been undertaken. A Building Condition Survey carried out by ARC will identify current defects within properties, some of which may need to be addressed immediately, along with those issues that are likely to arise long term and which can be dealt with through a programme of planned maintenance.

Where specific problems exist, and perhaps where there are contentious issues involved, then a more in depth Defects Investigation and Analysis can be carried out, leading to the preparation of an expert report that can later be used in dispute resolution proceedings.

When undertaking a Building Condition Survey, ARC will not only identify the key issues but will also recommend solutions to any defect that they find. This type of survey can save property owners/occupiers time and money by highlighting issues and/or potential problems areas, allowing remedial work to be undertaken before more significant problems arise.

Expert Witness

Likewise, where an independent assessment of a dilapidations dispute is needed, either in the pursuit of, or defence of a dilapidations claim then we can bring our many years of experience to bear on the interpretation of lease obligations, defects analysis, and quantification of claims, and our knowledge and understanding of current case law to bear in the preparation of an expert report.
